By booking a tour with Black Swan Tours (ABN [Insert ABN]) or engaging with our services, you agree to the following terms and conditions. Please read them carefully before proceeding.

1. Booking & Payment

• Full payment is required at the time of booking for all public/shared tours.
• Bookings are not confirmed until payment is received and a confirmation email is issued.
• Payments may incur credit card surcharges. All transactions are processed securely.

2. Rescheduling & Cancellation by Guests

Public/Shared Tours

• Reschedule free of charge up to 48 hours prior to the tour, subject to availability.
• Cancellations more than 48 hours before: Full refund (minus any payment processing fees).
• Cancellations within 48 hours: 100% cancellation fee.
• No-shows: No refund or reschedule.

Private Tours / Group Charters

• 20% non-refundable deposit required at booking.
• Balance due 14 days before tour date.
• Cancel more than 14 days before: Deposit forfeited, balance refunded.
• Cancel within 14 days: 100% cancellation fee.
• Rescheduling is subject to availability and may incur an admin fee.

3. Cancellations by Black Swan Tours

We reserve the right to cancel tours due to low numbers, weather, or unforeseen circumstances. In these cases, you may reschedule or receive a full refund. We are not responsible for costs incurred beyond your tour payment.

4. Minimum Numbers

Some tours require a minimum number of participants to proceed. If not met, we will offer a reschedule or full refund.

5. Health, Safety & Behaviour

• Follow all guide and venue instructions.
• Alcohol laws apply — service may be refused to intoxicated guests.
• No alcohol or food may be consumed on vehicles.
• No smoking or vaping on board.
• Unruly guests may be removed without refund.

6. Photo & Media Use

Photos/videos may be taken during tours for promotional use (website, social media, advertising).

By joining a tour, you consent to this use unless you notify us in writing prior to your tour.

7. Liability Waiver

Participation is at your own risk. We are not liable for loss, injury, or damage not caused by our negligence.

8. Dietary Requirements & Accessibility

Inform us of dietary needs at least 48 hours in advance. We do our best to accommodate but cannot guarantee all requirements can be met. Please contact us if you have accessibility concerns.

9. Gift Vouchers

• Valid for 3 years from purchase.
• Non-refundable, not redeemable for cash.
• Standard booking and cancellation policies apply.

10. Lost Property

Items left on board will be kept for 14 days. Please contact us promptly to retrieve lost property.
